These Terms and Conditions are designed for Barnes Emeralds. They cover the essential legal and industry-specific protections required for selling high-value gemstones like emeralds and opals.
Terms and Conditions of Sale
1. Authenticity & Disclosure
Natural Origin: All gemstones sold by Barnes Emeralds are guaranteed to be natural unless explicitly labeled as "Lab-Created" or "Synthetic."
Treatment Disclosure: In accordance with FTC guidelines, we disclose all known gemstone enhancements (e.g., oiling for emeralds, heating for sapphires). Specific treatment codes are provided on each product invoice.we assume treatment unless otherwise disclosed and is opinion based.we will disclose all enhancements if any upon request.
The "Jardin": Buyers acknowledge that natural emeralds contain internal inclusions (the jardin). These are characteristics of the stone's natural growth and are not considered defects.
2. Grading & Certification
Third-Party Reports: High-value stones are accompanied by reports from recognized laboratories (e.g., GIA, IGI, or GRS).can also be requested for submission.
Weight Variance: Carat weight is measured with precision; however, a tolerance of 0.01 to 0.05 carats may exist due to scale calibration differences.
3. Returns & Refunds
10-Day Inspection Period: We offer a 10-day "No-Questions-Asked" return policy for loose gemstones, starting from the date of delivery.
Condition for Return: Stones must be returned in their original, unset, and unaltered condition. Any stone that has been set into jewelry, chipped, or re-cut by the buyer is ineligible for return.
Documentation: All original laboratory certificates and invoices must be included in the return. A fee of $150–$250 will be deducted for any missing gemstone certificates.
4. Custom Jewelry & Settings
Final Sale: Once a loose gemstone from our inventory is set into a custom mounting at the customer's request, the sale is considered Final.
Setting Risks: While we take every precaution, emeralds are brittle stones. Barnes Emeralds is not liable for damage occurring during third-party setting services not performed by our in-house master jewelers.
5. Shipping & Liability
FOB Origin: All shipments are "Free on Board" from our facility. Risk of loss passes to the buyer upon delivery to the carrier.
Insurance: We ship via high-security couriers (e.g., FedEx Priority Overnight with Malca-Amit or Brinks). Signature is mandatory for all deliveries.
6. Pricing & Payment
Market Fluctuations: Prices are subject to change without notice based on market availability.
International Orders: Buyers are responsible for all import duties, VAT, and local taxes required by their country of residence.
